Privacy Policy

Miami Arts Charter School ("the School," "we," "us") is a tuition-free public charter school for grades 6 through 12 in Miami, Florida, governed by the Miami Arts, Inc. Board of Directors. This Privacy Policy explains what information we collect through our website, miamiartscharter.net, and through our text messaging program, how we use it, when we share it, and the choices you have.

This policy covers the website, the forms on it, and text messages exchanged with the School. Student education records are governed by federal and Florida law and by the policies in the Parent and Student Handbook (opens in a new tab), not by this policy.

1. Information we collect

Information you give us. When you fill out a form on our website, such as a request to be contacted, an inquiry, an event RSVP, an employment application, or a volunteer clearance request, we collect what you enter: typically your name, phone number, email address, your relationship to a student, and the content of your message.

Text messages. When you text the School or opt in to receive text messages, we collect your mobile phone number, the messages you send and receive, the date and time of each message, delivery status, and your opt-in and opt-out history.

Chat widget. Our website includes a chat widget, currently provided by Avochato, that lets you message school staff from the site. Messages you send through it, and any contact details you provide with them, are processed by that provider on our behalf.

Information collected automatically. Like most websites, we collect technical information when you visit, such as your browser type, device type, the pages you view, the site that referred you, and an approximate location derived from your IP address. We collect this through cookies and similar technologies, described in section 8.

Information from services linked from our site. The Parent Portal, lunch program, ticketing, school store, online application, and tour booking are operated by other companies under their own privacy policies. The School receives from those services only the information needed for school purposes, such as a completed application or a ticket order.

2. How we use information

We use the information we collect to:

• respond to your inquiries and requests;
• communicate with parents, guardians, and prospective families about admissions, enrollment, attendance, schedules, closures, events, and performances;
• operate, secure, and improve the website and understand how it is used;
• process employment applications and volunteer clearances;
• keep records and meet our obligations under Florida law, including public records and records retention requirements.

We do not sell personal information, and we do not use it for advertising by third parties.

3. Text messaging

Miami Arts Charter School offers a text messaging program so families and prospective families can reach school staff and receive school communications by text. You can opt in by submitting your mobile number through the inquiry form on our website, by agreeing to text communications on an enrollment or registration form, or by texting the School's number. You can opt out at any time by replying STOP to any message.

We use your mobile number only to respond to your inquiry and to send the school communications you have agreed to receive. Our messaging delivery provider processes messages on our behalf and may not use your information for any other purpose.

Mobile phone numbers and text messaging opt-in data and consent will not be shared with or sold to any third parties or affiliates for marketing or promotional purposes. All categories of sharing described in this policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. When we share information

We share personal information only in these situations:

• Service providers. Companies that host our website, deliver text messages and email, provide the chat widget, provide analytics, or run our application and enrollment systems. They may use the information only to provide services to the School.
• School district and state agencies. As a public charter school, we report to Miami-Dade County Public Schools and the Florida Department of Education as required by law.
• Public records requests. See section 5.
• Legal requirements and safety. When required by law, subpoena, or court order, or when necessary to protect the safety of students, staff, or the public.
• With your consent. When you ask us to share it.

We never sell personal information and never share it with third parties for their own marketing.

5. Public records

Miami Arts Charter School is a public school subject to Florida's Public Records Law, Chapter 119, Florida Statutes. Communications you send to the School, including email, website forms, and text messages, may be public records that are available for inspection and copying unless an exemption applies. Requests for public records may be directed to publicrecords@miamiartscharter.net. See our Public Records page.

Under Florida law, email addresses are public records. If you do not want your email address released in response to a public records request, do not send electronic mail to this entity. Instead, contact this office by phone or in writing.

6. Student records

Student education records are protected by the Family Educational Rights and Privacy Act (FERPA) and section 1002.22, Florida Statutes. This website is not a student information system. Please do not include confidential student information, such as grades, health details, or disciplinary matters, in website forms or text messages. Use the Parent Portal or contact the school office directly for those matters.

7. Children's privacy

Our website is intended for a general audience, and our text messaging program is intended for parents, guardians, prospective families, and other adults. We do not knowingly collect personal information from children under 13 through the website or by text. Students should communicate with the School through the channels the School provides to them. If you believe a child under 13 has submitted personal information through our website, contact us at mac@miamiartscharter.net and we will delete it, subject to our records retention obligations.

8. Cookies and analytics

We use Google Analytics to understand how visitors use the site, such as which pages are viewed and for how long. It sets cookies and collects the technical information described in section 1. We do not use this information for targeted advertising. You can limit analytics collection through your browser's cookie settings or with the Google Analytics opt-out browser add-on.

9. How long we keep information

We keep personal information for as long as needed for the purpose it was collected and as required by Florida's records retention schedules for public schools. Text message records are retained under those schedules. We keep opt-out records for as long as necessary to honor your choice.

10. Security

We use reasonable administrative, technical, and physical safeguards to protect personal information, and we limit access to staff who need it for their work. No method of transmission or storage is completely secure. Text messages are not encrypted by mobile carriers, so please do not send sensitive personal information by text.

11. Your choices

• Text messages. Reply STOP to any message to opt out. Reply HELP for assistance.
• Analytics. Adjust your browser's cookie settings or use the Google Analytics opt-out add-on.
• Your information. To review or correct information you have given us, contact mac@miamiartscharter.net.

12. Links to other websites

Our site links to services operated by other organizations. Their privacy practices are governed by their own policies, which we encourage you to read.

13. Changes to this policy

We may update this policy from time to time. The effective date at the top shows when it was last changed. Significant changes will be announced on the website.
